Neither should have a legal and living spouse while applying for a second marriage.
In case of registration under the Special Marriage Act, three witnesses are required

‘Tatkal’ Marriage Certificate
In Delhi, there is also a service called Tatkal marriage certificate for which couples can apply. The Revenue Department of the Delhi government in the year 2014 had introduced a ‘tatkal’ service to make sure there is a single-day authorization of the marriage followed under the registration process that can be undertaken at high priority. The service became operational on April 22, 2014, which lets the citizens register their nuptials and have a certificate get issued within24 hours on payment of Rs. 10,000 as a fee.
